Terms of service

These Terms and Conditions form a legally binding contract between the customer (referred to here as “customer” or “you”) and Electric Pedal Power (referred to here as “Electric Pedal Power”, “we”, “our” or “us”) and apply to the ordering, purchasing, fulfilment and delivery of Goods or Services. By placing an order for Goods or Services from us you agree to these Terms and Conditions. Please kindly read the following Terms and Conditions before placing your order.

APPLICABLE LAW

These Terms and Conditions are governed by the laws of Victoria, Australia. Any disputes arising in connection with these Terms and Conditions are subjected to the exclusive jurisdiction of the courts of Victoria, Australia. Electric Pedal Power makes no representation or warranty that the content of this Website complies with the laws of any country outside Australia. If you access this site from outside Australia, you do so at your own risk and are responsible for complying with the laws in the place where you access this Website.

DUTY OF CARE AND LOCAL JURISDICTION

Electric Pedal Power has taken reasonable steps to ensure your safety when using our products by carrying out a duty of care so far as is reasonably practical. For example, we supply a range of electric bikes including affordable ebikes yet, all of our ebikes are fitted with strong hydraulic disc brakes, have been sourced and supplied with the best possible parts within their price category and, have been limited to 25km/hr and a continuous power output of 250W when sold. However, we advise that upon receiving any of our products, you should check that the product is fit for your purpose, is regularly maintained by yourself (or by a suitably qualified bike mechanic) and that you have familiarised yourself with any relevant local legislation or regulations for the operation of our products and stick to these. 

Electric Pedal Power assumes no liability for negligence of care such as injuries or damages occurring to yourself or others or property arising from use of our products especially if operating the product outside of your local legislation or regulations. If, at any stage, you feel unsafe or unsure about using our products you must contact us, and if it is a warranted concern, we will amend it for you in accordance with Australian Consumer Law. DIY KITS OR CUSTOM EBIKE BUILDS

Electric Pedal Power offers affordable DIY ebike kits. When installing the DIY kit, please ensure that you are suitably qualified, have the appropriate tools and follow the instructions provided. Please kindly read the item description and follow the instruction manual provided. We will not be held liable for incorrect installations which can lead to unsafe operation of your bicycle. We offer an instore service to fit the kit to your nominated bicycle for you and highly recommend utilising this service. You can request this by contacting us. Interstate customers are encouraged to use a local bicycle mechanic workshop but are also welcomed to forward their bike to us for fitment. Please contact us if at any time you are unsure of the correct installation procedure.

As part of our services, we can also build you a dream customised ebike instore to your desired needs. This may include bringing in your existing bicycle frame so we can build the ebike from the ground up or simply upgrading an existing ebike or doing anything in between. We typically need to physically view the donor bike before providing you with an accurate quote. Interstate customers may be required to provide us with a short video and photos of the donor bicycle or potentially forward the bicycle to us for an initial quote. Based on our experience, we may refuse to build your requested ebike if we deem it to be unsafe to be converted or built as a custom ebike. This may include, but not be limited to, requests to retrofit a damaged or structurally weak bicycle frame with a powerful electric motor and/or any unsafe practices such as not fitting sufficiently strong brakes to the completed bike or retrofitting batteries in an unsafe manner.

CANCELLATION OF ORDERS

Electric Pedal Power reserves the right to cancel an order it previously accepted, at any time and for any reason. We will notify you if this occurs and provide you with a full refund.

Electric Pedal Power may cancel an order if we are unable to supply Goods or Services that we previously promised to supply due to errors in our website stocktake, description errors, mistakes in our pricing, descriptions, or photos or the like and/or anything beyond our control such as natural disasters or the like.

You can request to cancel your order, however, please carefully check your order when placing it. If you have made a mistake with your order and wish to cancel it, you may do so by contacting us as soon as possible. Electric Pedal Power may not change or cancel an order once it has been dispatched. Please refer to our Refund Policy for more information.

MODIFICATIONS TO THE SERVICE AND PRICES

Prices for our products are subject to change without notice.
We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time. We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.
